HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.7054 of 2024 ORDER :
Petitioner/A-1 has filed this petition seeking bail in Cr.No.279 of 2023 of P.S.Gachibowli, registered for the offences under Sections 447, 307 r/w. 34 of IPC.

Heard learned counsel for petitioner and the learned Additional Public Prosecutor appearing for the State.

The allegation against the petitioner is that on 28.02.2023 between 3 p.m. and 5 p.m., he, alongwith five others, have gone to the site where the complainant was working as a Site Engineer and asked him to open the locks of the gate. When the complainant refused to open the locks, the petitioner and five others beat him and the other guards with sticks and caused injuries.

The grounds for seeking bail are that there is land dispute between the petitioner and his brother and that an Advocate Commissioner was also appointed to record physical features and fix boundaries of the said land and keeping in view the same, a false case has been foisted against the petitioner. It is contended that the entire investigation is completed and only a charge sheet is to be filed and that the petitioner is a law-abiding citizen and is ready to co-operate
JS, J Crl.P.No.7054 of 2024 with the Police in investigating the case and that he will comply with the conditions that may be imposed by this Court in the event of his release.

The learned Additional Public Prosecutor opposed the application contending that in view of the allegations levelled against the petitioner and since the charge sheet is yet to be filed, the petitioner cannot be granted bail at this stage. 6.
Having heard both sides and perused the material on record, since the case has been registered without obtaining the medical opinion over the injuries sustained by the complainant and as the investigation is completed and only a charge sheet remains to be filed, this Court is of the considered view that it is a fit case for grant of bail.

Accordingly, this petition is allowed and the petitioner shall be released on bail on his executing a personal bond for Rs.20,000/- with two sureties for the like sum each to the satisfaction of the X Additional Metropolitan Magistrate, Prasanthi Nagar at Kukatpally. ____________________ JUVVADI SRIDEVI, J Date: 08.07.2024 ajr
