THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE No.97 of 2013 ORDER:

The order, violation of which is alleged in this Contempt Case, is the order passed in W.P.M.P.No.17234 of 2011 in W.P.No.14286 of 2011 dated 18.05.2011. The prayer sought in the aforesaid W.P.M.P. is to suspend the order in Case No.D1/32/2009 (File No.D1/2645/2009) dated 23.04.2011 passed by the Joint Collector, Mahaboobnagar District pending disposal of the Writ Petition. This Court directed status quo to be maintained.

A counter-affidavit is filed by the Tahsildar stating that, in the W.P.M.P, the petitioners had sought a direction not to alter the entries in respect of the subject land in the ROR; as per the direction of the Joint Collector dated 23.04.2011 necessary corrections had already been made against the subject land in the ROR on 13.05.2011; and a copy of the status quo order dated 18.05.2011 was received in their office on 27.06.2011 long after the corrections were made in the ROR. It is evident from the counter-affidavit that the corrections in the ROR were made on 13.05.2011, prior to the order of this Court dated 18.05.2011. The order of status quo passed by this Court has, therefore, not been violated. I see no reason, therefore, to proceed against the respondent under the Contempt of Courts Act, 1971. The Contempt Case is, accordingly, closed. Miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs.
