This writ petition is filed seeking the following relief :- " ...... to issue a writ, order or direction more in the nature of Mandamus to declare the action of the Respondents in not considering the case of the Petitioner for compassionate appointment to any of the suitable post as a social security measure as per the policy of the Government as illegal, arbitrary, discriminatory and violative of Articles 14, 16 and 21 of the Constitution of India and consequently direct the Respondents to appoint the Petitioner in any of the suitable post under compassionate grounds from the date of her eligibility, as per the policy of the Government and in accordance with Law ......" .

Heard Mr.P.Amarender, learned counsel for petitioner and the learned Government Pleader for Services-III. It has been contended by the petitioner that her husband, who was employed as a Gang Mazdoor with the respondents, expired on 24.10.2008. After the death of her husband, she submitted a representation to the respondents on 25.12.2008 requesting to consider her case for appointment on compassionate grounds in any suitable post. But, so far, the respondents have not passed any orders on the said representation nor considered her case for appointment on compassionate grounds in any suitable post.

Learned counsel appearing for the petitioner contended that appropriate orders be passed in the writ petition directing the respondents to consider the case of petitioner for appointment on

compassionate grounds by duly considering the representation submitted by the petitioner on 25.12.2008.

Learned Government Pleader appearing for respondents has contended that the case of the petitioner will be considered and appropriate orders would be passed on the representation submitted by the petitioner in accordance with law. This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 25.12.2008 for compassionate appointment and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.
