Heard.

The petitioners state that they are lawful owners and possessors of the land admeasuring Ac.3-00 gts., in Sy.Nos.33 to 39 situated at Guttala Begumpet Village, Serilingampally Mandal, Ranga Reddy District, having purchased the same under registered sale deed, dated 07-11-1974. The petitioners state that Possession Certificate was also issued in their favour by the 3rd respondent on 11-11-1991. In order to protect the said land from encroachment, the petitioners intend to fix fencing around the said land, which is stated to have been obstructed and opposed by the 3rd respondent.

The petitioners specifically state in paragraph '6' of the affidavit as follows:- ".... The petitioners further undertake that they will not raise any pucca construction or plotting over the subject land without obtaining necessary permission from the competent authorities..." Learned Government Pleader for Revenue states that if the petitioners intend to erect temporary compound wall, as per the undertaking extracted above, there is no objection for the respondents.

Recording the same, therefore, the 3rd respondent is directed not to obstruct the erection of temporary compound wall around the land of the petitioners. Subject to the undertaking, as extracted above, the writ petition is disposed of. No costs.

Miscellaneous petitions, if any, pending shall stand closed. _______________________
