THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17455 OF 2019 O R D E R :

This writ petition is filed challenging the action of the respondents 3 and 4 in calling the petitioner to the police station and threatening him to vacate/evict the house bearing No.8-2-1 to 3 and in asking the petitioner to sit in the I Town Police Station, Kothagudem, for long hours at the instance of respondents 5 and 6.

Learned Assistant Government Pleader for Home produced written instructions dt.14.08.2019 submitted by the Asst.Sub-Inspector of Police, Kothagudem I town Police Station, Bhadradri Kothagudem District. To the extent of their relevance to the present writ petition, the said instructions read as under:

" It is submitted that the allegations made by the petitioner that the respondent police are asking to sit in the police station from morning to evening is false and denied herewith, as the respondent police never called the petitioner to police station nor made the petitioner to sit in the police station.

It is submitted that basing on the complaint of one Md.Parveen, a case is registered against the petitioner Mohammed Abdul Azeem and Mohammed Reshma in Crime No.91/2019, under Sections 294(b), 323, 506, r/w.34 IPC of Kothagudem I Town Police Station 04.08.2019. Wherein the petitioner is arrayed as Accused No.1.

Keeping that in mind the above case, the petitioner had come up with present writ petition to bring pressure on the police officials, all the averments and contention raised in the writ affidavit are false are denied."

Learned counsel for the petitioner submits that the respondent police are pressuring the petitioner to vacate the subject premises. In view of the aforesaid written instructions, recording the same, the writ petition is disposed of directing the respondent police not to interfere with the civil disputes pending between the petitioner and unofficial respondents. However, this order will not preclude the respondent police from investigating the aforesaid crime. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
