HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.Nos.37962 & 37930 OF 2015 COMMON ORDER Since the issue involved in both the writ petitions is one and the same, they are being disposed of by this common order.

Both the writ petitions are filed challenging the impugned transfer orders, whereunder the petitioners were transferred to outside the District.

The grievance of the petitioners that the impugned transfer orders are contrary to the guidelines of the Central Government, according to which, they should not be transferred out of the District.

This Court vide order dated 20.11.2015 directed the respondents not to give effect to the impugned orders. In view of the same, the petitioners are continuing in their respective districts and almost three years have elapsed. Learned counsel appearing for the petitioners submits that the District is a unit for the anganwadi workers and the respondents cannot transfer the petitioners outside the district.

Learned Government Pleader for Women and Child Welfare submits that in view of the interim order granted by

this Court on 20.11.2015, the petitioners are not disturbed and they are continuing in their respective districts. Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that the impugned transfer orders were issued without jurisdiction, and contrary to the Rules. Hence, the impugned transfer orders are liable to be set aside.

Accordingly, both the writ petitions are allowed setting aside the impugned transfer orders. No costs. Miscellaneous petitions, if any, pending shall stand closed.
