The petitioner, who is A4 in Crime No.54 of 2017 of Maredumilli Police Station, filed the present application under Sections 437 and 439 Cr.P.C. seeking enlargement on bail in the above crime, registered for the offence punishable under Section 8(c) r/ w 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the Act'). 2.

Heard the learned counsel for the petitioner and the learned Public Prosecutor representing the State. 3.

A perusal of the material on record shows that the twin requirements of Section 37 of the Act are not satisfied. The fact that some other accused are granted bail without consideration of the mandatory twin requirements of Section 37 of the Act is not even a ground to grant bail, leave about the submission of the learned Public Prosecutor that any steps are going to take against those orders.

Accordingly, the Criminal Petition is dismissed. However, the above observations will not take away any defence of the petitioner/ accused during trial.

Consequently, miscellaneous petitions, if any shall stand closed.
