THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.19418 of 2019 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: "to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus, by declaring the in action of respondent Nos.3 and 4 in regularizing my land under Sadhabynama, basing on the representation of the petitioner, as illegal and arbitrary."

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents.

The grievance of the petitioner is that though he filed an application on 08.06.2018 before the 5th respondent for regularization of Sadhabynama in all the revenue records as per ROR Act, in respect of the subject land, but so far no orders have been passed.

Having regard to the same and considering the facts and circumstances of the case, without going into the merits of the same, the Writ Petition is disposed of directing the 5th respondent to consider the application of the petitioner, dated 08.06.2019, for regularization of Sadhabynama in all the revenue records as per ROR Act, in respect of the subject land. If the said application is not available with the authorities concerned, liberty is given to the petitioner to submit a fresh application ventilating his grievance

and on filing of the same, the authorities concerned shall consider the same and pass appropriate orders in accordance with law by following due procedure prescribed under ROR Act, within a period of three (3) months from the date of receipt of a copy of this order.
