THE HONB'E SRI JUSTICE CHALLA KODANDARAM WRIT PETITION No.1440 OF 2007 ORDER:

The writ petition is filed questioning the excess fixed demand charge of Rs.10,251/- and LPF surcharge of Rs.7,423,69 for the month of January, 2007.

The grievance of the petitioner is that without there being any demand or enquiry, the respondent raised a bill for Rs.13,026/- as fixed/demand charge and Rs.7,423.69 ps as LPF surcharge. The writ petition is of the year 2007 and no counter-affidavit has been filed by the respondent.

This Court while admitting the writ petition on 13.02.2007 granted interim stay. Prima facie, L.P.F surcharge is leveiable in the event the establishment owner installed the capacitors. However, considering the fact that the stay was granted and when there was no counter-affidavit filed, the writ petition is disposed of giving liberty to the petitioner to approach the respondent raising the objections with respect to raising of the bill within a period of two weeks from the date of receipt of copy of this order. As and when such objections are filed, the same shall be considered and necessary orders shall be passed within a period of two weeks, in accordance with the law and as per the regulations in vogue. However, as the stay was granted on 13.2.2007 in favour of the petitioner, stay shall be continued till the disposal of the representation that may be submitted by the petitioner.

Subject to the above, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any pending in this writ petition shall stand closed.
