Heard the learned counsel for the petitioner. 2.

The prayer sought in the Writ Petition is as under: "...to issue a writ, order or direction more particularly, one in the nature of writ of mandamus declaring the prescribing of a condition of successful candidate being within "top 20 percentile of successful candidates in Class XII examination conducted by the respective boards in applicable categories" by Respondent Nos.1 to 5 for admission into participating IIT's as arbitrary, unreasonable, unjust, unfair, discriminatory, biased and in violation of the petitioner's fundamental rights guaranteed by Article 14 of the Constitution of India and to direct the respondents to admit the petitioner into the course offered by the IIT's based on his preference and ranking in JEE (Advanced)-2013 by setting aside seat cancellation letter dated 04.07.

2013 issued by the 4th respondent or in the alternative to declare the action of the respondent Nos.

respondent Nos.3 to 5 to admit the petitioner into the B.Tech Course into IIT, Guwahati based on his ranking in JEE (Advanced)-2013 by setting aside the seat cancellation letter dated 04.07.2013 issued by the 4th respondent."

Learned counsel appearing for respondent No.2 would submit that in the light of the order sought in the Writ Petition, no further cause would survive in the present Writ Petition and hence, the Writ Petition has become infructuous. 4.

Taking into consideration the said submission, the Writ Petition is dismissed as infructuous.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
