HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39726 of 2016 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With consent of both the parties, the writ petition being heard at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not considering and disposing of the appeal filed by the petitioner against the order of the fourth respondent in Proceedings No.B/ 1748/ 2016, dated 20.05.2016, as arbitrary, illegal and contrary to law.

3) Though various grounds are raised in the writ petition, the grievance of the petitioner is that though an appeal was filed on 19.07.2016 till date no orders passed in the appeal. 4) The Government Pleader for Revenue submits that a direction may be issued for an early disposal of the appeal. 5) Without going into the merits of the case and having regard to the submissions made, the present writ petition is disposed of, directing the third respondent to dispose of the appeal filed by the petitioner against the order of the fourth respondent in Proceedings No.B/ 1748/ 2016, dated 20.05.2016 or pass orders on the stay application filed along with the appeal, after hearing all the concerned including the petitioner, in accordance with law, as expeditiously as possible, preferably, within a period of six (06)

months from the date of receipt of a copy of the order. However, if there is an application made for stay of the order under challenge, the same shall be dealt with in accordance with law, preferably, within a period of four (04) weeks. There shall be no order as to costs.

6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
