THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 15035 OF 2018 O R D E R:
The case of the petitioner is that she is the absolute owner of the land admeasuring to an extent of Ac.6-30 cents situated in Sy.No.61 of Vinjaram village, Polavaram Mandal, West Godavari District. The said property was acquired by way of succession after the demise of her husband and she has been in possession and enjoyment of the said land. While the things stood thus, on 04.08.2017 her relatives along with some other persons highhandedly entered into her field and ploughed the said land and destroyed the green-gram crop in the subject land, as such she sustained loss to a tune of Rs.2,00,000/-. The said people have also created some forged documents and placed the issued before the Mandal Revenue Officer. Since the Mandal Revenue Officer did not adjudicate the matter she approached the 4th respondent and gave a written complaint, dated 04.08.2017, with a request to provide police protection to her and her property. However, no action has been taken by the respondent authorities. Hence the Writ Petition.
Heard the learned counsel for the petitioner. The learned Government Pleader for Home (AP) submits that he received written instructions from the 4th respondent-SubInspector of Police, Polavaram Police Station stating that a case has already been registered on 26.04.2018, vide Crime No. 50 of 2018, for the offences under Sections 447, 427, 506 r/w 34 IPC, and he placed a copy of the FIR on record.
-2Since the complaint has already been registered, respondent No.4 shall cause investigation forthwith, and file a report under Section 173(2) of the Criminal Procedure Code at the earliest.
The Writ Petition is, accordingly, closed. There shall be no order as to costs.
Miscellaneous petitions pending, if any, shall also stand closed.
