HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.311 of 2014 ORDER:

This petition is filed to withdraw O.P.No.25 of 2012 from the file of Senior Civil Judge, Repalle and transfer the same to Senior Civil Judge, Mangalagiri, Guntur District for disposal in accordance with law.

2. Petitioner herein is wife and she filed her affidavit in support of petition, according to which, her marriage was performed with respondent on 02.06.2002 and that she was necked out from matrimonial house on 18.06.2012 and since then she has been residing with her parents' house at Mangalagiri. She stated that she filed M.C.No.81 of 2011 before Additional Junior Civil Judge, Mangalagiri and the same is allowed on 17.01.2013. She further stated that a criminal case is registered against respondent in C.C.No.203 of 2012 and the same is pending before Additional Junior Civil Judge, Mangalagiri and respondent as a counter-blast to harass her filed the present O.P.No.25 of 2012 before Senior Civil Judge, Repalle.

She contended that she apprehend danger to her life in the hands of respondent at Repalle and no prejudice would be caused to respondent if the O.P. is transferred to Mangalagiri, as he is already attending Repalle Court in connection of criminal case. She further contended that she has got minor child and it is difficult for her to attend Repalle Court. On these grounds, she prayed for transfer of O.P.No.25 of 2012 from Senior Civil Judge, Repalle to Senior Civil Judge, Mangalagiri, Guntur District.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard argument of advocate for petitioner.

5. Considering the reasons stated in the affidavit and also considering the convenience of petitioner/wife, O.P.No.25 of 2012 is withdrawn from Senior Civil Judge, Repalle and transferred to Senior Civil Judge, Mangalagiri, Guntur District for disposal in accordance with law.

6. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
