HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.7140 of 2024 ORDER :
Petitioner/A-1 has filed this petition seeking bail in Cr.No.180 of 2024 of P.S.Prohibition and Excise Station, Dhoolpet, Hyderabad, registered for the offences under Sections 8(c) r/w. Section 20(b)(i)(B) of NDPS Act.

Heard learned counsel for petitioner and the learned Additional Public Prosecutor appearing for the State.

The allegation against the petitioner is that she along with her son (A-2) were found in possession of 8.26 kgs of dry ganja in their house.

The grounds for seeking bail are that the petitioner herein and her son (A-2) were living in the same house and that she does not know as to how the ganja was kept in their house, but the Police, without investigating the case properly, have registered the case against her. It is contended that the petitioner is a law-abiding citizen and is ready to co-operate with the Police in investigating the case and that she will comply with the conditions that may be imposed by this Court in the event of her release.

The learned Additional Public Prosecutor opposed the application contending that in view of the allegation of possessing 8.26 kgs. of dry ganja in her house, the petitioner cannot be granted bail at this stage.

Having heard both sides and perused the material on record, since 8.26 kgs. of ganja is less than the commercial quantity and since the petitioner is a woman aged 63 years, this Court is of the considered view that it is a fit case for grant of bail. 7.
Accordingly, this petition is allowed and the petitioner shall be released on bail on her executing a personal bond for Rs.20,000/- with two sureties for the like sum each to the satisfaction of the Metropolitan Sessions Judge, Hyderabad.
