THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.4977 of 2018 ORDER:

This Criminal Petition, under Section 438 Cr.P.C., is filed to enlarge the petitioners on bail in the event of their arrest since they are apprehending arrest in connection with Crime No.73 of 2018 on the file of Station House Officer, Huzurabad Police Station, Karimnagar, registered for the offences under Sections 379 of IPC and Section 21(1) of Mines and Minerals ( Development and Regulation) Act, 1957. After arguing the matter for awhile, learned counsel for the petitioners, requested this Court to direct the concerned to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar and another1 In view of the request made by the learned Counsel for the petitioners, the Police of Huzurabad Police Station, Karimnagar, are directed to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines laid down by the Supreme Court in Arnesh Kumar's case referred supra.

With the above direction, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
