THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.10026 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the impugned action of the respondents for not extending the conveyance allowance payable to physically handicapped persons like petitioner as arbitrary, unjust, capricious, discrimination as well as in violation of Art. 14, 16 & 21 of the Constitution of India and consequently, the petitioner pray this Hon'ble Court may be pleased to direct the respondents to pay the conveyance allowance payable to the petitioner from the date of joining or at least from the date of regularization in the interest of justice and fair play."
Heard Sri V. Narasimha Goud, learned counsel for the petitioner and Sri R. Vinod Reddy, learned Standing Counsel for respondents.
When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 2703-2014 to the 3rd respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 3rd respondent to pass appropriate orders on the representation, dated 27-03-2014, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Standing Counsel for respondents and submitted that the said representation would be
considered, in accordance with law.
For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 3rd respondent to consider and pass appropriate orders on the representation, dated 27-03-2014 said to have been submitted by the petitioner herein, in accordance with law, within a period of six
(6) weeks from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
