HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.14444 of 2009 ORDER:

This Writ Petition is filed to declare the action of the 1st respondent in issuing notice dated 27.06.2009 under Section 15(2) of A.P. Charitable and Hindu Religious Endowments Act (Act 30 of 1987) as amended by Act 33 of 2007 inviting applications for the appointment of constituting Board of Trustees for Sri Bhoosametha Vijaya Venkateshwara Swamy Temple, Appayyanagar, Visakhapatnam, as illegal and arbitrary.

When the matter is taken up for hearing, learned standing counsel for the 3rd respondent-Temple submits that, according to Section 17(2) of the Endowments Act, the Trustees appointed under Section 15 is for a period of two years from the date of commencement and as the said two years period has already elapsed, no further orders are necessary in the present writ petition. As seen from the impugned notice, the notification was issued on 27.06.2009. As the period for Board of Trustees is only for two years and the said period is already over, no further orders are necessary in the present writ petition.

The writ petition is, accordingly, closed. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. ________________________ KONGARA VIJAYA LAKSHMI, J Date: 27.11.2018 BSS
