Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents.
The petitioner was appointed as fair price shop dealer of Shop No.25 of Charlagudipadu Village, Gurazala Mandal, Guntur District. He submitted an application to the second respondent-Revenue Divisional Officer, Gurazala on 24.02.2015 for sanction of medical leave for a period of three months. Since the petitioner was on medical leave, the fourth respondent-Tahsildar, Gurazala Mandal passed an order appointing in-charge dealer by order dated 08.04.2015.
The said leave expired by the end of May, 2015. Unfortunately, the stock was not released to the petitioner in the month of June, 2015. Aggrieved by the same, the present writ petition is filed. The learned counsel for the petitioner submits that the authorization of the petitioner is valid and the medical leave applied by him also expired and therefore, the petitioner is entitled for release of the stock onward distribution to the stock cardholders. In the circumstances, the writ petition is disposed of directing the respondents 3 & 4 to release the stock to the petitioner so long as the authorization of the petitioner is in force and valid. Miscellaneous Petitions, if any pending in this writ petition shall stand closed. No order as to costs.
