HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 21701 of 2016 ORDER:

Heard learned counsel for the petitioners, Government Pleader for Mines and Geology and Government Pleader for Revenue.

There is no necessity to put the unofficial respondent on notice as this Court is not venturing to adjudicate the issue on merits.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the official respondents in precluding the illegal mining of the eighth respondent in an extent of 5.20 hectares in Sy.No.335 of Rapaka Gram Panchayat, Pondur Mandal, Srikakulam District, as illegal, arbitrary and violative of Articles 14 and 19 (1) (g) of the Constitution of India.

Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the official respondents to dispose of their representation dated 08.01.2016 at the earliest. Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the official respondents to pass appropriate orders on the representation dated 08.01.2016 made by the petitioner bringing to their notice about the illegal mining done by the eight respondent, in accordance with law, as

expeditiously as possible, preferably within a period of three (03) weeks from the date of receipt of a copy of the order, if the same is made and still pending consideration, after hearing the petitioner as well as the eight respondent. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
