THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.17433 of 2019 ORDER:
Heard Sri M.Maddileti, learned counsel for the petitioner and Sri B.Mayur Reddy, learned Standing counsel for TSRTC appearing on behalf of the respondents. It has been contended by the petitioner that he is working as Assistant Engineer (Mechanical) at Gadwal Depot and has been discharging his duties to the best satisfaction of his superiors and everyone concerned. While so, on the allegation of negligence and slackness in discharging his duties, a charge sheet was issued against him on 28.02.2018, for which he submitted explanation on 05.03.2018 to the 3rd respondent. But the 3rd respondent without considering his explanation, imposed punishment of deferment of two annual increments without cumulative effect vide order dated 07.03.2018. Against the said order, the petitioner preferred an appeal on 15.03.2018 before the 2nd respondent.
But so far, the 2nd respondent has not passed any orders on the appeal preferred by the petitioner. Therefore, learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the appellate authority to consider the appeal preferred by the petitioner and pass appropriate orders in accordance with law.
Learned Standing counsel appearing for the respondents contends that the appeal preferred by the petitioner on 15.03.2018 would be considered by the appellate authority and appropriate orders would be passed in accordance with law.
This Court, having considered the rival submissions made by the learned counsel on either side, is of the considered view that this writ petition can be disposed of directing the appellate authority/2nd respondent to pass appropriate orders on the appeal preferred by the petitioner on 15.03.2018, in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. With the above observations, this writ petition is disposed of. No order as to costs.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
