O R D E R

The case of the petitioner is that he was initially appointed in Kukatpally Municipality in the year 1987 as NMR (Last Grade Service Employee) and subsequently Government issued G.O.Ms.No.533, Municipal Administration and Urban Development (F2) Department dated 29.11.2011, regularizing services of 306 NMRs, who are working in all circles and the name of the petitioner was at Sr.No.140 of the said G.O. The said G.O. was issued in terms of G.O.Ms.No.212, Finance (PC.III) Department, dated 22.04.1994. Petitioner was extended revised pay scales of 2010. While so, Government issued revised pay scales of 2015 vide G.O.Ms.No.25, Finance (HRM.IV) Department dated 18.03.2015. Revised pay scales of 2015 were extended to many of the employees whose services were regularized in terms of G.O.Ms.No.533 dated 29.11.

When the revised pay scales of 2015 were not extended to one M.D.Mynuddin and seventeen others, who are working in the same circle, they made representation dated 08.09.2015. As the same was not considered, they filed O.A.No.2295/ 2016 and the Andhra Pradesh Administrative Tribunal, by order dated 22.06.2016, directed the 4th respondent - Deputy Commissioner, Kukatpally Circle XIV to consider the representation 08.09.2015 and dispose of the same on merits within a period of two months from the date of receipt of the order. Aggrieved by the action of the 4th respondent in not implementing the order of the Tribunal, the applicants in the said O.A., filed W.P.No.44940/ 2017, and the Division Bench of this court, by order dated 17.4.

When the said order was not implemented, petitioners in W.P.No.44940/ 2017, filed C.C.No.1423 of 2017, and the respondents extended the revised pay scales of 2015 vide G.O.Ms.No.25 dated 18.03.2015. In these circumstances, as the petitioner was not extended the 2015 revised pay scales, he got issued legal notice dated 16.11.2015. As no action has been taken, present writ petition came to be filed.

Heard the learned counsel for the petitioner and Government Pleader for Finance and Planning for 2nd respondent and Sri Sampath Prabhakar for respondents 3 to 6 and Government Pleader for Municipal Administration for respondent No.1.

Having regard to the above averments of the petitioner and the submissions of the learned counsel, without expressing any opinion on merits, the 4th respondent - Deputy Commissioner, GHMC, Circle XIV, Kukatpally Circle, Hyderabad is directed to consider the claim of the petitioner vide his legal notice dated 16.11.2015 in accordance with law and pass a reasoned order within a period of two months from the date of receipt of a copy of this order.
