THE HONOURABLE SRI JUSTICE N.TUKARAMJI CRIMINAL PETITION No.4508 OF 2022 ORDER:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking pre-arrest bail to the petitioners/accused Nos.2 and 3 in F.I.R.No.308 of 2022 of Sanathnagar Police Station, Cyberabad, registered for the offences punishable under Sections 376, 420 and 506 r/w 34 of IPC. 2.
The case of the prosecution is that the de-facto complainant and her acquaintances invested an amount of Rs.5,00,00,000/- in the real estate firm of 1st accused as he enticed her with good returns; further by deceitful words, he developed physical relationship with her and when she requested for return of the invested amount, he used to threaten to publicize the intimate videos between them. Later when she approached the petitioners herein, who are wife and sister-in-law of the 1st accused for return of the amount, they threatened her with dire consequences. 3.
Sri K. Jyothi Prasad, learned counsel for the petitioners contended that there are no specific overt acts against the petitioners. There are no averments against the petitioners in the complaint with regard to the alleged offences and they were falsely implicated. Even if the
complaint is taken as it is, at the best the alleged offence under Section 506 of IPC will only attract, however, the petitioners are ready to cooperate with the investigation and as they are apprehending arrest from the police, praying for grant of pre-arrest bail.

Learned Assistant Public Prosecutor fairly admitted that the allegations against petitioners attracts only 506 of IPC.

Perused the record and having regard to the facts and circumstances of the case and nature of allegations, I am inclined to grant pre-arrest bail to the petitioners on the following conditions:
1) Applicants shall be released in the event of their arrest pre-arrest bail to the petitioners/accused Nos.2 and 3 in connection with F.I.R.No.308 of 2022 of Sanathnagar Police Station, Cyberabad, registered for the offences punishable under Sections 376, 420 and 506 r/w 34 of IPC on their execution of personal bonds for Rs.25,000/- with two sureties likesum by each of the petitioners to the satisfaction of the Station House Officer, Sanathnagar Police Station.
2) The petitioners shall furnish their address and contact numbers and changes if any from time to
time to the investigating officer till final disposal of the case.
3) The petitioners shall remain present before the investigating officer whenever required for the purpose of investigation and shall cooperate with the investigation.
4) The petitioners shall not directly or indirectly meddle with the investigation and play mischief with the evidence collected or yet to be collected by the investigating agency.
Miscellaneous petitions pending, if any, shall stand disposed of.
