HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 40923 of 2016 Order:

This Writ Petition was filed to declare FIR No.307 of 2016, dated 07.10.2016, on the file of the second respondent as illegal. Today, when the matter is called, none appeared for the petitioners. However, it is brought to the notice of this Court by the learned counsel appearing for the third respondent that the petitioners filed Criminal Petition No.15024 of 2016 for quashing the same complaint and this Court dismissed the said Criminal Petition on 02.11.2016 and suppressing that fact the present Writ Petition was filed on 24.11.2016. This is a clear case of abuse of process of Court. Hence, the Writ Petition is dismissed with costs of Rs.1,000/- (Rupees One Thousand only) payable to the third respondent.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
