HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE Dr. JUSTICE SHAMEEM AKTHER WRIT PETITION No.6581 OF 2017 ORDER: (Per Hon'ble The Acting Chief Justice Ramesh Ranganathan) After arguing for some time, Mr. P.V. Krishnaiah, learned counsel for the petitioners, would draw our attention to the proviso to Section 77(3) of the Andhra Pradesh Reorganization Act, 2014 (for short, 'the Act') whereunder, the Central Government has been conferred the power to review any of its orders issued under Section 77 of the Act.
Learned counsel would submit that the petitioners would invoke the review jurisdiction of the Central Government under the proviso to Section 77(3) of the Act and, instead of adjudication of the petitioners' contention on merits, it would suffice if the Government of India is directed to consider their application for review within a specified time frame. Mr. B. Narayana Reddy, learned Assistant Solicitor General appearing on behalf of the 1st respondent, would submit that the petitioners' application for review would be considered within three (3) months from the date of its receipt. We consider it appropriate, therefore, to permit the petitioners to submit an application, for review, within two (2) weeks from today.
The 1st respondent shall consider the said application in accordance with law and pass orders thereon at the earliest, in any event, not later than three (3) months from the date of receipt of the petitioners' review application.
HACJ & Dr.SA,J WP No.6581/2017 The challenge to the validity of the Rule is left upon to be agitated by the petitioners, if need be, in appropriate legal proceedings. The writ petition is, accordingly, disposed of. As a sequel, pending miscellaneous petitions, if any, shall stand dismissed. No order as to costs.
