THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7185 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.890 of 2023 on the file of Meerpet Police Station, Rachakonda, registered for the offence under Section 363 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.
The allegation against this petitioner is that he is the maternal Aunt's son of the victim girl. In the year, 2021, the victim girl went to the village where the petitioner was staying. The petitioner allegedly expressed his love to her and promised to marry her, for which she refused. Again in the year, 2023, he met her. Both of them went to their Aunt's house where the petitioner had forcible sexual intercourse. After coming to know that a
case was registered on 09.06.2023 by the Police, the victim girl was dropped in her house on 10.06.2023. 4.
Learned Additional Public Prosecutor on instructions would submit that medical evidence does not reflect any injuries on the body of the victim girl. 5.
Keeping in view that the petitioner and de-facto complainant are first cousins and also the petitioner had expressed his willingness to marry the victim girl and in view of the completion of major part of the investigation, this Court deems it appropriate to grant the relief of regular bail to the petitioner, subject to following conditions:
i) The petitioner/Accused shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of VI Additional Metropolitan Magistrate, Rachakonda at L.B.Nagar.
ii) The petitioner/Accused after release shall appear before the concerned Station House Officer at 10:00 a.m.
every Monday and
Wednesday for a period of eight weeks and thereafter, as and when required for the purpose of investigation.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
