THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4507 of 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Criminal Procedure Code by the petitioner/A2 in Crime No.176 of 2021 of Parkal Police Station, Warangal Rural District, registered for the offences punishable under Section 8(c) read with 20(b) of the NDPS Act.

The case of the prosecution is that on 08.08.2021 on the information, the police conducted vehicle check and seized one TATA ACE vehicle and found 64.410 Kgs. of Ganja which was seized in the cover of panchanama.

According to the learned Assistant Public Prosecutor, all the accused were present when the alleged seizure has taken place. 4.

The other accused who are Accused Nos.1, 3 to 7 were granted bail by this Court and the learned counsel for petitioner/A2 seeks bail on the ground of parity. 5.

In the said circumstances, the petitioner/A2 is directed to be released on bail on the following condition. The petitioner/A2 is directed to be released on bail on his executing personal bond for Rs.50,000/- (Rupees Fifty Thousand only) with two sureties each for a likesum, to

the satisfaction of Additional Judicial First Class Magistrate, Parkal, Warangal District. On such release, the petitioner/A2 shall appear before the police concerned till completion of trial on every Sunday between 10.00 a.m. and 1.00 p.m.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any, pending shall stand closed.
