HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 8430 OF 2004 ORDER :

This writ petition is filed seeking to issue a writ of certiorari calling for the record relating to and connected with I.D.No.23 of 1996 on the file of the 2nd respondent-Industrial Tribunal-cum-Labour Court, Godavarikhani and quash the order dated 24.07.2000 passed therein confirming the order of removal of petitioner from service.

Heard Sri Venkateshwar Varanasi, learned counsel for the petitioner and Sri P.Sridhar Reddy, learned standing counsel for the 1st respondentcorporation. 3.

When the matter is taken up for hearing, it is brought to the notice of the Court that the petitioner has attained the age of superannuation during pendency of the writ petition.

Learned counsel for the petitioner mainly contends that the terminal benefits of the petitioner prior to his removal from service may be paid to him.

Having considered the submissions made by both the parties and after perusing the record, I am of the view that the petitioner is entitled for the terminal benefits for the service rendered by him prior to his removal from service. Accordingly, the writ petition is disposed of directing the 1st respondent corporation to pay the terminal benefits of the petitioner for the service rendered by him prior to his removal from service, if not already

paid, in accordance with the Regulations, within a period of four (4) weeks from the date of receipt of a copy of this order. 6.
