THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.15508 OF 2018 ORDER:
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: "to issue a writ, order or direction more in the nature of Mandamus or otherwise declaring the action of the 1st respondent in not taking further action against the party respondents in pursuance of FIR No 54/2018 Dated 12.02.2018 on the file of Muvvavanipalem P.S.
Muvvavanipalem, Visakhapatnam District under sections u/s 420, 448, 506, 509 r/w 34 IPC by the 1st respondent, as arbitrary, illegal, discriminatory, malafide violating Article 14 and 21 of the Constitution of India and contrary to the law laid down in case of Lalitha Kumari V State of UP reported in 2014 [2] SCC -1 in WP [Crl] 68/2008 Dated 12.11.2013, and issue consequential directions, directing the official respondents No.1 to 5, to take appropriate action as per law against the party respondents No.6 to 9 respectively in pursuance of the FIR No 54/2018 Dated 12.02.2018 on the file of Muvvavanipalem P.S.
Muvvavanipalem, Visakhapatnam District, registered u/s 420, 448, 506, 509 r/w 34 IPC by the 1st respondent as per the law laid down in case of Lalitha Kumari V State of UP reported in 2014 [2] SCC - 1 in WP [Crl] 68/2008 Dated 12.11.2013." 2.
I have heard the submissions of Ms. S.V.Indira, learned counsel for the petitioner, and of the learned Government Pleader for Home (A.P.) appearing for the respondents 1 to 5. I have perused the material record.

Though several allegations are made in the writ petition, at the hearing, learned counsel for the petitioner submitted that if a direction is given to the Station House Officer, Muvvavanipalem Police Station, Muvvavanipalem, Visakhapatnam District, to expedite the investigation into the aforestated crime and file a final
report/charge sheet in accordance with law, the grievance of the writ petitioner stands redressed.

Learned Government Pleader for Home, having taken notice, endorses the said submission.

Recording the submissions, the Writ Petition is disposed of directing the Station House Officer, Muvvavanipalem Police Station, Muvvavanipalem, Visakhapatnam District, to expeditiously investigate into the aforestated crime and file a final report, either way, by strict adherence to the procedure established by law. There shall be no order as to costs. Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
