HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4944 of 2019 ORDER:

1) The present Criminal Petition is filed under Section 482 of Cr.P.C., questioning the order, dated 10.04.2019 passed in Crl.M.P.No.739 of 2019 in C.C.No.508 of 2018 on the file of the II Additional Junior Civil Judge-cum-XVI Additional Metropolitan Magistrate, Cyberabad at Rajendranagar, wherein and whereunder an application for interim custody of the original passport to the petitioner/ A6 to enable her to go to U.S.A. was dismissed. 2) At the time when the matter is taken up for hearing, learned counsel for the petitioner submits that the petitioner seeks return of her passport only up to 31.01.2020 and she will be returned back to India by 31.01.2020 and she undertakes to attend the Court thereafter.

3) Learned counsel appearing for the second respondent opposed the same contending that the case is posted before the trial Court on 31.12.2019.

4) Without going into the merits of the case and having regard to the facts and circumstances, the Criminal Petition is disposed of directing the II Additional Junior Civil Judge-cum-XVI Additional Metropolitan Magistrate, Cyberabad at Rajendranagar, to return the original Passport bearing No.P2912626 to the petitioner/ A6 forthwith, subject to the condition of the petitioner/ A6 executing a personal bond to the tune of Rs.5,00,000/ - with two sureties for

a like sum each to the satisfaction of the above Magistrate. Further, the petitioner shall give an undertaking before the trial Court that she will return to India by 31.01.2020 and thereafter attend the trial Court, without fail.
