THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36436 of 2016 ORDER:

This writ petition is filed seeking to declare the inaction of respondents 2 & 3 in not taking any action against the trespassers as made in the complaint, dated 19.09.2016, and to take appropriate action by granting police protection to the petitioner to protect his property and life and liberty, as illegal and arbitrary.

Heard and perused the material available on record. The case of the petitioner is that the petitioner is the absolute owner and possessor of the land to an extent of Ac. 5.52 cents under R.S.No.27/2, situated at Taduvaye Grama Shivar of Jangareddigudem Mandal and that some persons illegally trespassed into the land of the petitioner in respect of doing cultivation while using the high handed influence from the incompetent authorities and also using the political influences with the support of local police and revenue authorities and also encroached his land without any substantial and valid reasons, for which, the petitioner made a number of visits to the concerned police station and also the revenue authorities, but in vain. The main grievance of the petitioner is that the petitioner made a representation, dated 19.09.

2016 to grant police protection to the petitioner to protect his property and life and liberty to respondents 2 & 3, but respondents 2 & 3 have not taken any action against the trespassers. Considering the grievance of the petitioner, respondents 2 & 3 are directed to consider the representation, dated 19.09.2016, of the petitioner and it is left open to respondents 2 & 3 to give police protection to the petitioner in respect of his subject property, if there is any necessity.

Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
