THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.17625 of 2019 ORDER:
The present writ petition is filed questioning the action of the respondents in refusing to receive and register the complaint made by the petitioner on 04.06.2019.
By order dated 19.08.2019, this Court, while taking note of the fact that even the complaint sent by the petitioner through registered post was also refused to be received by the police personnel, directed the second respondent to look into the matter as to non-acceptance of postal covers by the respondent authorities, take appropriate action and file his report before this Court.
A counter-affidavit is filed by the third respondent, wherein it was stated that based on the complaint filed by the petitioner, the respondent authorities have registered a case in Crime No.223 of 2019 under Sections 120(b), 447, 427, 420, 468 and 471 of IPC on the file of Manuguru Police Station, against the unofficial respondents herein, on 23.08.2019, and have taken up the investigation. In the said counter, it is also stated by the third respondent that, pursuant to the order passed by this Court on 19.08.2019, an enquiry was conducted into the matter and two police personnel were identified as responsible for refusing to receive the registered post sent by the petitioner and they have been issued Charge Memos on 15.10.2019. It is further stated that, upon receipt of explanation submitted by the said police personnel, the third respondent passed orders on 17.10.2019 awarding punishment of 'censure'.
Being satisfied with the explanation offered and taking note of the submission made in the aforestated counter-affidavit, inasmuch as the grievance of the petitioner stands redressed and as no further orders are required to be passed in this writ petition, the writ petition is dismissed. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
