THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5202 OF 2017 ORDER:

This writ petition is filed challenging the action of the respondents 1 and 2 in interfering with the matrimonial dispute between the petitioner and the fourth respondent. It is stated that respondents 1 and 2 are threatening the petitioner to vacate the house bearing No.24-4-4, Uppucheruvu Village, Kandukuru Mandal, Prakasam District, and deliver the same to the fourth respondent without following due process of law. Learned Government Pleader, on the basis of the written instructions, submits that the petitioner lodged a complaint on 07.06.2014 to the second respondent against the fourth respondent and the same was registered as crime No.91 of 2014 on the same day. A charge sheet was also filed pursuant to the investigation and the same is numbered as C.C.No.966 of 2014 by the Additional Judicial Magistrate of First Class, Kandukur.

The petitioner lodged another complaint on 11.11.2016 and the same was registered as crime No.162 of 2016 and the investigation is pending. The investigation revealed that the accused did not trespass into the land and accordingly, the Sub Divisional Police Officer granted permission on 03.01.2017 to refer the case as false. A final report was filed on 17.02.2017 before the Additional Judicial Magistrate of First Class, Kandukur. With regard to other allegations of interference of the second respondent in matrimonial disputes and threatening the petitioner to vacate the house they are denied.

In view of the same, no orders are necessary in the present writ petition. The writ petition is accordingly closed. Consequently, miscellaneous petitions pending, if any, shall also stand closed. __________________________ A.RAMALINGESWARA RAO, J 15.03.2017 pln
