HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.8213 OF 2017 ORDER:

Heard the learned counsel for the petitioners/ accused of Crime No.312 of of J.Madugu (U) Police Station, Y.S.R.District, registered for the offences punishable under Sections 342, 307, 498(A) r/ w 34 I.P.C., which is an outcome of the report of the 2nd respondent and learned Public Prosecutor appearing for the State. The notice ordered to the 2nd respondent to the address given in the F.I.R. is returned as incomplete, thereby, deemed sufficient service, for no full address with the Court, otherwise so, to direct even the accused to take fresh notice. Perused the grounds urged in the Criminal Petition and the contents of F.I.R.

On perusal of the material on record, there is nothing to interdict the investigation by going into the merits, but for, to say whatever the material available in the claim of innocence of the petitioners, they are entitled to file the same before the investigating officer to include as part of the investigation material. All the defences are left open.
