ORDER:

This writ petition is filed for a mandamus to declare the proceedings, dated 01.12.2011, of respondent No.1 removing the petitioner from the fair price shop dealership as illegal and arbitrary.

The petitioner sought for a consequential direction to respondent No.1 to continue him as the fair price shop dealer for shop No.290/A(new No.613) of Swaroop Nagar Village, Uppal Mandal and Municipality.

At the hearing, Mr.W.B.Srinivas, learned counsel for the petitioner, submitted that pending the writ petition, the petitioner died. In view of death of the sole petitioner, the cause in the writ petition does not survive for adjudication and the Writ Petition is accordingly dismissed as abated.

As a sequel to dismissal of the writ petition, interim order, dated 27.12.2011, in W.P.M.P.No.42534 of is vacated and W.P.M.P.No.42534 of 2011 filed by the petitioner for interim relief shall stand dismissed as infructuous.
