THE HONBLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HONBLE SRI JUSTICE A.SHANKAR NARAYANA O.S.A. No. 39 OF 2015 Judgment: (Per the Hon'ble Sri Justice V Ramasubramanian) This appeal is filed purportedly under Clause 15 of the Letters Patent read with Section 483 of the Companies Act, 1956 (for short 'the Act'), against an order passed by the learned Company Judge in an appeal under Section 10F of the Act.

Heard Mr. Vedula Venkata Ramana, learned Senior Counsel appearing for the appellants and Sri S. Ravi, learned Senior Counsel appearing for the respondents.

The present appeal, as it arises out of an order passed by the learned Single Judge in an appeal under Section 10F of the Act is not maintainable, in view of the decision rendered by the Supreme Court in Kamal Kumar Dutta v. Ruby General Hospital Limited[1]. Therefore, the appeal is dismissed.

Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
