This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused, for grant of anticipatory bail in Crime No.207 of 2018 of Khammam II Town Police Station, Khammam District, registered for the offence punishable under Section 420 of IPC.

Heard learned counsel for the petitioner/ accused, learned Additional Public Prosecutor representing the respondent/ State and perused the record.

Learned counsel for the petitioner/ accused would submit that the petitioner is working as a Journalist in a leading newspaper. He is no way connected with the above offence and he has been falsely implicated in this case. The petitioner has not taken an amount of Rs.58,000/ - from the de facto complainant on the premise of providing a Government job to her. The petitioner is ready to abide by the conditions imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.

Learned Additional Public Prosecutor representing the respondent/ State opposed to grant bail to the petitioner/ accused. 5.

The allegation levelled against the petitioner is that he has taken the said amount to provide Government job to the de facto complainant, but failed to do the same. When the de facto complainant demanded to repay the same, the petitioner has paid Rs.10,000/ - and evading to pay the remaining amount and thereby cheated her. Hence,

this Court is not inclined to grant anticipatory bail to the petitioner/ accused.

In the result, the Criminal Petition is dismissed. However, if the petitioner/ accused surrenders before the trial Court concerned within ten days from the date of this order and move an application for regular bail, after giving prior notice to the Public Prosecutor concerned, the same may be considered in accordance with law. ___________________ JUSTI CE G.
