HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.7126 of 2024 ORDER :
Petitioner has filed this petition seeking bail in C.O.R.No.294 of 2011 of Prohibition and Excise Station, Narayankhed, registered for the offence under Section 20(a)(i) of NDPS Act. 2.
Heard learned counsel for petitioner and the learned Additional Public Prosecutor appearing for the State.

The allegation against the petitioner is that he was found cultivating 58,467 ganja plants in one acre of land. 4.
The grounds for seeking bail are that the land in question does not belong to the petitioner, and inspite of the same, a false case has been registered against him. It is also contended that the present case has been registered against the petitioner on 18.11.2011, but he was not arrested till his surrender before the Police on 27.05.2024. 5.
The learned Additional Public Prosecutor opposed the application contending that since the petitioner was found cultivating large number of ganja plants, he cannot be granted bail at this stage. 6.
The record reveals that though the present crime has been registered against the petitioner on 18.11.2011, Police could not arrest him till he surrendered before them on 27.05.2024. Since many years
JS, J Crl.P.No.7126 of 2024 have passed from the date of occurrence of offence, this Court is of the considered view that it is a fit case for grant of bail. 7.
Accordingly, this petition is allowed and the petitioner shall be released on bail on his executing a personal bond for Rs.20,000/- with two sureties for the like sum each to the satisfaction of the I-Additional District and Sessions Judge, Sangareddy. ____________________ JUVVADI SRIDEVI, J Date: 08.07.2024 ajr
