Patnala Narasinga Rao, v. The State Of Andhra Pradesh,
IN THE HIGH COURT OF JUDICATURE, AT HYDERABAD
FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH **** W.P.NO. 39086 OF 2015 Between:
Patnala Narasinga Rao S/o Lakshman, Proprietor ....Petitioner A n d The State of Andhra Pradesh, Civil Supplies Department and two others
...Respondents
DATE OF ORDER: 31.12.2015
HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION NO. 39086 OF 2015 O R D E R:
Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies.
Petitioner assails the proceedings dated 7.11.2015 of the second respondent directing the interim disposal through public distribution system of 'Redgram dal', other pulses and oil seized from the petitioner's Kirana stores pursuant to an inspection done on 5.11.2015.
Counsel for the petitioner states that none of the stocks seized from the petitioner's business premises were likely to decay and there was no necessity to direct interim disposal of the same under Section 6-A (2) of the Essential Commodities Act, 1955.
Learned Government Pleader for Civil Supplies does not dispute this fact.
Therefore, pending disposal of 6-A proceedings against the petitioner, stocks seized from the petitioner's premises shall not be disposed of. The said proceedings shall be completed as expeditiously as possible, preferably within a period of four months from the date of receipt of a copy of this order.
The Writ Petition is disposed of with the above observation. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
