HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.45980 of 2016 O R D E R :
The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ or order, more particularly one in the nature of writ of Mandamus declaring the inaction of the 3rd respondent in not receiving the complaint lodged by the petitioner dated 22-12-2016 and not registering a crime basing on the complaint and not investigating into the matter as illegal and arbitrary and consequently direct the 3rd respondent to receive the complaint given by the petitioner. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home and perused the material available on record. Considering the facts and circumstances of the case, the 3rd respondent is directed to register the complaint, dated 22-12-2016, of the petitioner, if it is lodged for cognisable offence.
Accordingly, the Writ Petition is disposed of. No Costs. Consequently, miscellaneous petitions pending in this petition, if any, shall stand closed.
