THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22820 OF 2017 ORDER:

This writ petition is filed challenging the notice issued under Section 7 of the Andhra Pradesh Land Encroachment Act, dated 29.06.2017 in respect of land of an extent of Acs.0.10 guntas in survey No.224 of Manchirevula Village, Gandipet Mandal, Ranga Reddy District. The case of the petitioner is that the petitioner purchased the land of an extent of Acs.11.57 guntas in survey Nos.168 and 223 of Manchirevula Village under valid registered sale deed and pattadar pass books and title deeds are also issued. The petitioner also filed O.S.No.364 of 2017 before the Court of the Principal Senior Civil Judge, Ranga Reddy District, and there is an order of status quo. In spite of the same, when the notice is issued, the present writ petition is filed.

Since this is a show cause notice, this Court is not inclined to entertain the writ petition. However, the writ petition is disposed of giving liberty to the petitioner to submit explanation bringing it to the notice of the respondents the facts stated in the affidavit filed in support of the writ petition. Since there is a dispute with regard to identity of the land and its location in the particular survey number, the respondents shall conduct survey and pass appropriate orders before taking any coercive action against the petitioner. The writ petition is accordingly disposed of.
