HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.7125 of 2024 ORDER :

Petitioner/A-3 has filed this petition seeking bail in Cr.No.139 of 2024 of P.S.Shadnagar, registered for the offences under Sections 366, 376(2)(n), 316 and 109 of IPC, Section 5(j)(ii)(l) r/w.6 of POCSO Act, 2012 and Section 5 of Medical Termination of Pregnancy Act, 1971.

Heard learned counsel for petitioner and the learned Additional Public Prosecutor appearing for the State.

The allegation against the petitioner is that she terminated the pregnancy of a minor girl and that she is practicing as an RMP without any permission.

The grounds for seeking bail are that the petitioner did not commit any offence as she has not terminated the pregnancy and that the minor girl has given birth to a child. It is contended that the petitioner is a law-abiding citizen and is ready to co-operate with the Police in investigating the case and that she will comply with the conditions that may be imposed by this Court in the event of her release.

The learned Additional Public Prosecutor opposed the application contending that in view of the allegations levelled against the petitioner, the petitioner cannot be granted bail at this stage. 6.

Having heard both sides and perused the material on record, as the investigation insofar as the allegation against the petitioner herein with regard to termination of pregnancy is completed, this Court is of the considered view that it is a fit case for grant of bail. 7.

Accordingly, this petition is allowed and the petitioner shall be released on bail on her executing a personal bond for Rs.20,000/- with two sureties for the like sum each to the satisfaction of the Special Judge for trial and disposal of POCSO Act cases, Ranga Reddy District at L.B.Nagar.
