THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.4110 OF 2009 ORDER:

This writ petition is filed seeking to issue writ of mandamus declaring the action of the respondents in not considering the resolution of the petitioner gram panchayat, dated 27-09-2008 seeking permission to conduct quarrying operations in Reach No.5 VRB from 39.000 K.Ms., to 45.400 K.Ms., Ramp point at 44/600 K.M., to 44/800 K.M., near Koderu village, Achanta mandal, West Godavari District, by transporting sand with the weight of 10.00 tonnes over the Koderu lock by the petitioner gram panchayat as illegal, arbitrary and for a consequential order directing the respondents to permit the petitioner to conduct the quarrying operations in the above mentioned reach and to ply the vehicles over the Koderu lock with a load of 10.00 tonnes till the regular auction is conducted.

2. The relief sought for in the present writ petition relates to quarrying the sand. In view of subsequent changes in the policy of the Government from time to time, nothing survives for consideration in the present writ petition.

3. Accordingly, the writ petition is dismissed as infructuous. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
