Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents. The petitioner was appointed as fair price shop dealer of shop

No.14 of Murarichinthala Village in Lingala Mandal of YSR Kadapa District. The authorization of the petitioner is valid up to 31.03.2016. The third respondent-Tahsildar, Lingala Mandal, submitted a report to the second respondent-Revenue Divisional Officer, Jammalamadugu, on 13.05.2015 stating that the petitioner is running the shop through a benami and based on the said report, a show cause notice was issued to the petitioner on 25.05.2015. The petitioner submitted her explanation on 30.05.2015. Not satisfied with the said explanation, the second respondent passed an order dated 03.06.2015 suspending the authorization of the petitioner pending enquiry. The allegations against the petitioner are three including the allegation of running the shop through benami.

The petitioner more or less admitted the same and stated that in view of the death of her husband, shop is being run by her brother-in-law. In the circumstances, the matter has to be enquired by the second respondent and this Court is not inclined to express any opinion on the merits of the case at this stage. However, the second respondent is directed to complete the enquiry and pass final orders thereon after due notice and opportunity to the petitioner, within a period of thirty days from the date of receipt of a copy of this order.

With the above directions, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions pending, if any in this writ petition, shall stand closed.
