The petitioner is aggrieved by the order dated 21.08.2017 passed by the Tahsildar, Nandigaon Revenue Mandal, Ranga Reddy District, the 3rd respondent, under Section 7 of the Andhra Pradesh Land Encroachment Act, 1905 (for short, 'the Act'). 3.

Aggrieved by the said order, remedy of appeal is available under Section 10 (1) (a) of the Act and without availing the said remedy, petitioner filed this Writ Petition.

Learned counsel for the petitioner submits that appeal, along with an application for stay of the order passed by the original authority, was already preferred by the petitioner. 5.

In view of the same, the Writ Petition is accordingly disposed of directing the appellate authority to consider the stay application filed by the petitioner after affording due opportunity to him and pass appropriate orders as expeditiously as possible preferably within a period of four weeks from the date of receipt of a copy of this order. Pending consideration of the stay application, the petitioner shall not be dispossessed from the subject property. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
