HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.22190 OF 2016 ORDER:

The writ petition is filed questioning the high handed action of the 5th respondent-Gram Panchayat, by issuing the proceedings dated 02.07.2016, to remove the shops of the petitioners situated at P.A. Pally Village and Mandal, Nalgonda District.

It is the case of the petitioners that they had constructed small temporary structures with 10 feet x 10 feet in P.A. Pally Village and Mandal, Nalgonda District and running cool drinks shops and barber shop for the last eight years. The said shops were provided with electricity service connection. The petitioner have not occupied the road and there are no complaints from any of the villagers. The petitioners are eking out their livelihood on the shops and sought some time to vacate the said shops. Learned counsel for the petitioners seeks three months time to vacate and to find out alternative accommodation for establishing the shops and the learned Government Pleader for Panchayat Raj did not oppose the same.

Having considered the respective submissions and in the facts of the present case, the writ petition is disposed of giving liberty to the petitioners to approach the Gram Panchayat seeking time to vacate the shops and the Gram Panchayat shall consider the request of the petitioners for granting of time on condition of their filing an undertaking before the Gram Panchayat stating that the petitioners would vacate the shops within a period of three months.

Accordingly, the writ petition is disposed of with the above observations. No order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
