THE HON'BLE SRI JUSTICE A.V. SESHA SAI Writ Petition No.16268 of 2015 ORDER:

Heard Sri Sricharan Telaprolu, learned counsel for the petitioners and the learned Government Pleader for Higher Education. The grievance of the petitioners in the present writ petition is that the 3rd respondent has rejected the approval with respect to spot admissions made by the first petitioner-institution and the list of candidates, whose admissions are rejected, shows that it was rejected on the ground that the students, who were admitted, belong to other States. The very similar aspect was considered by this Court in W.P.No.32797 of 2014 and batch, which was allowed on 31.10.2014. The learned counsel appearing for the respondents 3 & 4 fairly states that the issue, as adjudicated by this Court in W.P.No.24581 of 2009 and batch, dated 20.11.2009 has attained finality. In view of that, following the same ratio, W.P.No.

32797 of 2014 and batch was allowed on 31.10.2014. In view of the same, the present writ petition is allowed in terms of orders in W.P.No.32797 of 2014 and batch, dated 31.10.2014, which are as follows: "The impugned proceeding so far as it relates to rejection of candidature of students admitted by the petitioner-institute respectively only on the ground that they belong to other States shall stand set aside subject to the condition that the admitted students are eligible for admission and qualified for that.

The respondents 2 and 3 shall, therefore, re-examine the matter and pass appropriate orders expeditiously preferably within two weeks from the date of receipt of a copy of this order, in the light of directions of this Court, referred to above."

No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
