HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.7163 of 2024 ORDER :

Petitioner/A-2 has filed this petition seeking bail in C.O.R.No.137 of 2023 of Excise Police Station, Dhoolpet, registered for the offences under Sections 8(c) r/w. Section 20(b)(ii)(B) of NDPS Act.

Heard learned counsel for petitioner and the learned Additional Public Prosecutor appearing for the State.

The allegation against the petitioner is that 1.90 kgs. of dry ganja was found in in his house.

The grounds for seeking bail are that the petitioner herein was living in the same house along with his mother (A-1) and that merely basing on the confession of A-1, the petitioner herein was arrested and that the petitioner is a law-abiding citizen and is ready to co-operate with the Police in investigating the case and that he will comply with the conditions that may be imposed by this Court in the event of his release.

The learned Additional Public Prosecutor opposed the application contending that in view of the allegation of possessing

Having heard both sides and perused the material on record, since 1.90 kgs. of ganja is intermediate quantity and since the petitioner is arrested merely basing on the confession of A-1 and further, petitioner was not involved in any other case, this Court is of the considered view that it is a fit case for grant of bail. 7.

Accordingly, this petition is allowed and the petitioner shall be released on bail on his executing a personal bond for Rs.20,000/- with two sureties for the like sum each to the satisfaction of the Metropolitan Sessions Judge, Nampally, Hyderabad. ____________________ JUVVADI SRIDEVI, J Date: 08.07.2024 rev
