When the matter is called, it is reported by the learned Government Pleader that a third party has already been appointed against the subject post. Learned counsel appearing for the petitioner seeks permission of this Court to withdraw the writ petition with a liberty to assail the said order.

Permission is accorded.

Accordingly, the Writ Petition is dismissed as withdrawn, with the liberty as prayed for. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
