HON'BLE SRI JUSTICE S.V. BHATT W.P.No.2947 of 2015 ORDER:

Petitioner complains against the inaction of respondents in considering and disposing of representation dated 22.12.2014 filed for issue of No Objection Certificate (NOC) to sell house site of an extent of Ac.0.03 cents in Sy.No.426 of Molakalacheruvu Village and Mandal, Chittoor District as illegal and unconstitutional. In view of the objection raised by the 3rd respondent for registration of subject property the petitioner applied for NOC. The case of petitioner is that firstly, no NOC is required, even otherwise according to the applicable Government orders; the subject property cannot be included in the proprietary list. Therefore, appropriate orders are sought.

The inaction complained appears to be reasonable and the 2nd respondent is directed to consider and issue appropriate orders on the representation dated 22.12.2014 within two weeks from the date of receipt of a copy of this order.

Writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
