HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.7089 of 2024 ORDER :
Petitioners/accused Nos.2 and 3 have filed this petition under Section 438 of Cr.P.C. seeking anticipatory bail in Cr.No.104 of 2024 of P.S. Mugpal, registered for the offences under Sections 143, 148, 307, 332, 382, 447, 427, 186, 504, 506 r/w. 149 of IPC, Sections 3 (1) (r) (s) and 3 (2) (Va) of SCs and STs (POA) Act, 2015. 2.
Heard Sri Janardhan Goud Sunkari, learned counsel for petitioners and the learned Additional Public Prosecutor appearing for the State.

Case of the prosecution is that when the de facto complainant questioned these petitioners and other accused as to why they are ploughing the Government land, the petitioners, along with other accused, claiming to be the owners of said land, have attacked the complainant and her staff, with sticks and stones and also abused them in the name of caste.

Learned counsel for petitioners submits that the petitioners are innocent and have been falsely implicated in the case, though they are in no way concerned with the case. He further submits that there are
JS, J Crl.P.No.7089 of 2024 no specific overt acts against the petitioners, and hence, prayed to grant anticipatory bail to the petitioners.

The learned Additional Public Prosecutor opposed the application, as the matter needs to be investigated into. 6.
Having heard both sides and perused the material on record, since there are no specific overt acts against the petitioners and as twelve witnesses have already been examined, this Court is of the considered view that it is a fit case for grant of anticipatory bail, subject to the following conditions:
1. The petitioners shall surrender before the Station House Officer of P.S.Mugpal at Nizamabad District within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioners on bail on each of them executing a personal bond for Rs.20,000/- with two sureties, for the like sum each.
2. The petitioners shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.
Petition is accordingly allowed.
